The Indiana Attorney General's office will drop its case against a Carmel, Ind., physician it had previously accused of misconduct and being "unfit to practice," WRTV Indianapolis reported Nov. 26.
The motion was filed Nov. 7, and would drop the case against Clifford Fetters, MD, president of Health and Wellness in Carmel, which offers holistic cancer treatments. The complaints stem from a 13-count administrative complaint against his medical license, in which Dr. Fetters was accused of false and misleading advertising, failing to inform patients of side effects of tests and treatments and not providing a patient with a truthful account of her condition in May 2023.
The state's complaint alleged that Dr. Fetters was "unfit to practice due to failure to keep abreast of current professional theory or practice," which included touting "ozone therapy as therapeutic for cancer." The FDA prohibits ozone therapy for medical uses, calling it a "toxic gas."
In the motion, the state said that it had engaged in discovery since May 2023, including a deposition of Dr. Fetters. Upon re-evaluating its current evidence and receiving new evidence, the state has determined that it "now lacks the evidence to support the charges" against Dr. Fetters. The state told WRTV that the new evidence is confidential.
The state Medical Licensing Board will hear the motion Dec. 5.
