Former Oklahoma physician pleads guilty to drug charges, Medicaid fraud

Former Oklahoma City physician Harvey Jenkins has pleaded guilty to Medicaid fraud and multiple drug offenses.

Mr. Jenkins was charged with 29 felony counts and one misdemeanor in 2016, according to a Feb. 27 news release from the Office of the Oklahoma Attorney General Gentner Drummond.

He was accused of prescribing large volumes of opioids while he was operating Aria Orthopedics, where he mostly cared for Medicaid beneficiaries, from January 2010 to February 2015, in addition to using another physician's signature to write prescriptions without approval.

Mr. Jenkins pleaded guilty to 18 counts of illegal possession, distribution, dispensing and prescribing of controlled dangerous substances; six counts of making or causing to be made false claims under the Oklahoma Medicaid program; five counts of failure to maintain Medicaid records; and one count of maintaining a place or building where controlled dangerous substances are kept.

The plea agreement includes a 20-year suspended prison sentence and $181,474.12 in restitution and fines. Mr. Jenkins also agreed to give up his medical license.
