Dr. Emery was charged with one count of conspiracy to distribute controlled substances and 11 counts of distribution of controlled substances outside the bounds of professional medical practice, according to a Sept. 29 Justice Department news release.
Dr. Emery allegedly conspired with others to intentionally and unlawfully prescribe, dispense and distribute — and did unlawfully prescribe, dispense and distribute — a mixture and substance containing a detectable amount of buprenorphine, a Schedule III controlled substance often used to treat opioid addiction.
If convicted, Dr. Emery faces a maximum penalty of 10 years in prison and a $500,000 fine on each count in the indictment, the release said.
