Federal telehealth updates in 2023

Here are five federal telehealth updates from 2023, according to a July 31 report from JDSupra:

  1. In May, HHS' Office of Inspector General released a report with findings from a national audit that evaluated compliance issues with psychotherapy services in Medicare, including those offered through telehealth.
  2. The DEA issued a statement in May extending the public health emergency flexibilities for controlled medication prescriptions via telehealth while looking for ways to apply appropriate safeguards.
  3. The Office of Inspector General released a toolkit in April that analyzes telehealth claims to assess program integrity risks.
  4. In February, the DEA published two proposed rules focused on the prescription of controlled substances via telehealth after the end of the public health emergency that would require an in-person visit before prescribing.
  5. CMS released guidance in January clarifying that interprofessional consultations can be reimbursed by Medicaid and CHIP even when the beneficiary is not present.
